General Terms and Conditions (GTC) for the online trade in baked goods

§ 1 Scope of application and provider

These General Terms and Conditions (GTC) apply to all orders placed by customers via the online shop of a la Maison GmbH.

The provider and contractual partner for all orders is a la maison GmbH.

The online shop is aimed at consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

§ 2 Offer and conclusion of contract

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. 

The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

§ 3 Contract language and contract text storage

The language(s) available for the conclusion of the contract: German, English.

§ 4 Pre-orders and minimum order value

Pre-orders are possible from a minimum order value of €10.

The products ordered are produced fresh on the day of collection and should be consumed on the same day, as they are perishable.

§ 5 Collection and consumption

Pre-orders in the online shop are binding and must be collected from the selected collection location within the agreed time slot.

It is not guaranteed that the ordered products will be available at a later time at the same or another location.

The products must be stored carefully by the customer from the time of collection and consumed on the same day, as there is no liability for quality defects at a later date.

§ 6 Right of return and refund

Due to the perishable nature of baked goods, there is no right of return after collection of the goods.

Pre-orders that are not collected within the agreed time frame will be cancelled. There will be no refund for these orders.

Uncollected products are donated at the end of the day and cannot be collected the next day.

§ 7 Cancellation

Cancellations of pre-orders must be sent by e-mail to shop@lamaison.berlin at least two days before the collection date.

A full refund of the purchase price will be granted for cancellations received two days before the collection date.

§ 8 Payment

Payment for the goods is made online during the order process using the available payment methods.

§ 9 Liability and defects

The provider is liable without limitation for intent and gross negligence. The Vendor shall only be liable for simple negligence in the event of a breach of a material contractual obligation; however, the amount of liability shall be limited to the foreseeable damage typical for the contract.

The supplier assumes no liability for the quality of the baked goods if they are not consumed on the day of collection.

The statutory liability for defects applies.

§ 10 Data protection

The data collected during the ordering process is used to process the order and to improve the offer. Further information can be found in the privacy policy.

§ 11 Dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are prepared to participate in an out-of-court arbitration procedure before a consumer arbitration board.

§ 12 Final provisions

The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
